Sujit Choudhry Writes About Poland

As an expert on constitutional law, Sujit Choudhry’s opinion and expertise have been sought recently due to the political turmoil that has been concerning much of the world in recent years. Sujit Choudhry has been published several times with his most recent piece being a chapter in the book Constitutional Democracies in Crisis? in which he addresses several topics concerning the political state in the United States (medium.com).

Much of the chapter has a strong focus on the political problems being brought up through social media about the constitution not being heeded as it should be. This problem has been getting worse since the time of the Cold War and Choudhry believes the presidency is becoming an autocracy. The current situation is being compared to what Poland is experiencing with the right-wing party known as Poland’s Law and Justice Party. Their constitution has been severely undermined since 2015 so they can achieve power that can’t be easily usurped. The first steps the party has taken to achieve power have involved the courts in the country, especially the Constitutional Court.

Their actions did not take place immediately or all at once. The process to undermine the constitutional authority of Poland has taken place since they came into power. The actions taken by the Law and Justice Party included taking control of the Constitutional Tribunal and have taken place in a way that attempts to hide their motives.

Sujit Choudhry is a professor along with being an international constitutional law expert. He has served at many prestigious institutions such as Berkely, NYU, and the University of Toronto. Check blogs.law.nyu.edu. The Rhodes Scholar even served the Supreme Court of Canada’s Chief Justice Antonio Lamer as his law clerk.
